In the process of management use, TP has reviewed and found the need to adjust the list of villas in the above scheme. Therefore, on July 4, 1977, the People's Council of Hanoi issued Resolution No. 04/2017 / NQ-HDND, including the adjustment of 141 villas out of the list of 970 villas under the management scheme. villa fund mentioned above. Up to now, the Hanoi People's Committee has reported and sought guidance from the Prime Minister on the disposal of 41 villas that were not sold under the former scheme, but are now on the list of 141 cases removed from the list. The list of villas in the direction: City People's Committee to report to the Standing People's Council to consider and decide whether to sell or not sell these villas.

In this regard, after review, the Ministry of Construction stated that: The need for the adjustment of the villa list. The Ministry of Construction recognizes that the decision of the Hanoi People's Council to adjust the list of villas promulgated together with the previous Resolution 18/2008 / NQ-HDDP is necessary in line with the practical and appropriate situation. with the provisions of the housing law.

On the authority to consider the treatment of villas not sold: According to report No. 234 / BC-UBND dated 24/8/2017, the Hanoi People's Committee proposed the Prime Minister to assign the People's Committee to report to the Standing People's Council. The city considered and decided to sell or not sell 41 villas that were not sold in the previous project but are now on the list of 141 villas.

The Ministry of Construction finds that, at Point f, Clause 1, Article 62 of Decree No. 99/2015 / ND-CP of October 20, 2015, the Government has specifically specified types of former State-owned dwelling houses entitled Not sold, including the villa included in the scheme that was approved by the Prime Minister prior to the effective date of Decree 99/2015 / ND-CP (41 of them in the city). Hanoi). Thus, the consideration and treatment of the 41 villas mentioned above falls under the jurisdiction of the Government.
